    These Terms and Conditions will form the basis of the contract between us in relation to use of your customer ParkRight account and so contain important information.  You agree to these Terms and Conditions by booking for parking, a permit and/or related services and when you request the creation of a ParkRight account on-line.   By creating your ParkRight account, you agree to be bound by these Terms and Conditions and in particular those matters for which we do not accept responsibility. 

    Application of these Terms and Conditions

    These Terms and Conditions apply to all ParkRight accounts created with us.   You create a ParkRight account with us by booking parking and/or related services and opting in have a ParkRight account.

    You are not required to create a ParkRight account with us, if you are booking parking and/or related services.

    Purpose of ParkRight Account

    The Parkright account allows you to access and buy parking and/or related services across a range of products for you to use, and allows you to access all your parking transactions in one place.  It also enables you to receive the latest parking news directly from Westminster City Council.  

    Information required to create your ParkRight Account

    To set up a Parkright Account, you must provide us with your surname, first name, email address, post code, telephone number, and vehicle registration number. Other information may also be requested.

    When you set up a Parkright Account, you confirm that all information provided by you is true and accurate in all respects and you will inform us as soon as possible of any changes to such information.

    You agree to ensure that your login details are kept secure and are not disclosed to a third party. If you suspect that someone else has or is using your details, you should change your password immediately. 

    Your ParkRight account is personal to you and should not be used or accessed by any other person.  Any other person wishing to have access to the benefits of having a ParkRight account with us will be required to set up a customer account in their own name.  

    We may immediately suspend or close a ParkRight Account if you act in breach of these Terms and Conditions or any terms and conditions relating to a Product.

    Limitation of liability

    We shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including damages for loss of profits, goodwill, use, data or other intangible losses (even if we has been advised of the possibility of such damages), resulting from the use or the inability to use or access your ParkRight Account, or from unauthorised access to or alteration of your Customer Information.

    Your legal rights

    Nothing in these Terms and Conditions shall take away or modify any of your legal rights or entitlements.

    Use of Customer Information and data protection

    We will store, process and use all personal information provided by you in connection with your ParkRight Account in accordance with the requirements of the Data Protection Act 1998 and our Data Protection Policy.  Details of our Data Protection Policy are available.

    We use Customer Information in the following ways:

    • to communicate with you about bookings, permits and other parking products.

    • to set up and maintain your ParkRight Account and to recommend products that might be of interest to you;

    • to enable third parties to carry out technical, logistical or other functions on our behalf;

    • to provide you with requested information or correspondence, such as a response from us to an enquiry made by you; and

    • to send you details of your new, amended or cancelled purchases or bookings - usually via email.

    Your contact details may be used to supply information to you by telephone, email or post, about us and to send you occasional marketing material.

    All customer Information we collect is important to us and we would not want to share this with anyone else.  Unless we have your express consent, we will never disclose, rent, trade or sell your personal data to any third parties for their marketing or mailing purposes. 

    Variation of Terms and Conditions

    We reserve the right to amend these Terms and Conditions at any time.  We will send you a copy of the amended Terms and Conditions by e-mail in advance.  By continuing to access and use your Parkright Account, you will be taken to agree to the amended Terms and Conditions. 

    We reserve the right to withdraw the right to create ParkRight accounts at any time. 

    Communications

    Applicable laws require that certain communications or information we send to you should be in writing.  By providing us with your email address as part of the ParkRight Account creation process, you agree to this electronic means of communication, and you acknowledge and agree that all contracts, notices, information and other communications we provide to you electronically comply with any legal requirement that such communication be in writing.

    Governing law and jurisdiction

    These Terms and Conditions are governed by, and shall be construed in accordance with, English law.  If you are a consumer, you may have rights to bring court proceedings in the courts of the country in which you are domiciled.  Otherwise, to the fullest extent permitted by law, you and we shall bring all court proceedings in the courts of England.

    Privacy Policy

    Westminster City Council will endeavour to safeguard the privacy of its website visitors.

    Information we collect

    We will collect personal details appropriate to the service you require. In some areas, this may simply mean registering your name, address and email details. Other on-line forms will require more information.

    Please note that calls to the Contact Centre may be monitored or recorded.

    How we use personal information

    There are various reasons that we need to collect personal data. For example, we may need your contact details for correspondence purposes. Similarly, we may need information because of legal requirements. Subject to your agreement, we may contact you to let you know about new online services, or get your feedback on how we're performing. In any event, we will only ever ask for information that is absolutely necessary and does not constitute an invasion of privacy.

    Allowing your details to be used across other council services

    We all get frustrated on occasion when we have to repeat the same basic information over and over again. Because of this, we're focussing on making it easy for people to do business with us, whenever and however they choose, all through a single contact, which should remember the relevant information.

    By actively allowing your details to be used across other council services, you are allowing us to re-use information to minimise the time taken when you contact us in the future.

    Rights

    Please note that in agreeing to share these details you have not forfeited your rights as prescribed under the Data Protection Act 2018 and the Council will continue to apply the same level of care to safeguard your privacy as we always have done. Your service entitlement from the Council will not be affected should you decide not to allow your data to be shared in this way.     Email messages

    We are keen to ensure that we are providing our citizens with services that they need. Consequently, you may receive occasional e-mail messages from Westminster City Council on matters that we consider may be of interest to you, if you have provided your email address to us for this purpose.

    Information to improve our site

    We collect web statistics automatically about your visit to our site based on your IP address. This information is used to help us track what people are doing on the site so that we can improve it. We don't use this information to identify you as an individual and you will remain anonymous, unless you're asked to identify yourself by completing a form or an online transaction.

    Cookies

    If you complete our online registration process, or subsequently login to the site, we will use cookies to remember your preferences during your current visit, and any future visits provided the cookie was not deleted in the interim. Cookies can be deleted at the end of each visit by logging out of the site. Your browser help text will contain information about how to refuse cookies from our site should you wish. Refusing cookies from our site will not affect your ability to perform online transactions, although we will not be able to display content that is relevant to you on certain pages, nor pre-fill forms with your name and contact details where relevant.

    Other cookies - we use Google Analytics on our site in order to know what is of most interest to our customers. Using the data collected we can then gear our website to providing a more effective website for our customers. Personal information is not collected in this process. We also use a product called Logo_Net. This code helps us track the route customers take through our website. Again we do not collect personal information. We want to ensure you reach your destination as quickly as possible and we will offer advice on what we think you may be looking for. For example, you may see suggestions on the right hand side of some pages or you may see a chat feature in order for you to have an online conversation with a member of staff. We would like you to continue to use our site with cookies switched on but if you are concerned you have the ability to turn them off though it will mean certain features of the site won't be available to you.
